What the FDA rule says
The FDA's over-the-counter hearing aid category went into effect on October 17, 2022. Under 21 CFR 800.30, an OTC hearing aid is intended for a person aged 18 or older “to compensate for perceived mild to moderate hearing impairment.” Output is capped at 111 dB SPL, or 117 dB SPL with input-controlled compression active, and the part deepest in the ear must stay at least 10 mm from the eardrum. The outside of the box must show the maker's return policy (or say there is none); the rule does not require a warranty. Buyers under 18 need a prescription. Reading the OTC prices
The cheapest OTC pair recorded is Audien Atom One at $98; the dearest is Audicus Mini 2 at $2,498, $2,400 more. Trial periods printed by the sellers run from 45 to 100 days and warranties, where printed, from 1 to 3 years; several sellers bundle remote audiology support, which is part of why prices this far apart sit in the same category. Three OTC brands, Lexie, Eargo and Go Hearing, posted wind-down notices in 2026, which is why they are absent; the shutdown guide lists their dates.
